1. The collection and use of personal information in connection with our Services will be for the purpose of improving CreditBird's service quality. You acknowledge that different terms of use and privacy policies may apply to third party use of services and content. CreditBird does not endorse third party services and content and under no circumstances will CreditBird be responsible or liable for any products or services of such third party providers. In addition, Apple Inc., Google, Inc., Microsoft Corporation or BlackBerry Limited and/or their applicable international subsidiaries and affiliates will be third parties to benefit from this agreement if you access access these Services using Applications developed for Apple iOS, Android, Microsoft Windows or Blackberry mobile devices, respectively. This third party beneficiary is not the parties to this contract and is not responsible for providing or supporting the Services in any way. Your access to the Services using these devices is subject to the terms set forth in the third party beneficiary's terms of service. Ownership. The Services and all rights herein are the property of CreditBird or the property of CreditBird's licensors. These Terms and your use of the Services do not represent or grant you any rights: (i) in or in relation to these Services, except for the limited license granted above; or (ii) in any way use or reference the company names, logos, product and service names, trademarks or service marks of CreditBird or its licensors. 3. Using CreditBird Service User account. To use most aspects of the Service, you must register and maintain an active individual User Service account (“Account”). Signing up for an account requires you to send CreditBird certain personal information, such as your name, address, mobile number and age, as well as at least one valid payment method. (or an approved credit card or payment partner). You agree to maintain accurate, complete and up-to-date information in your Account. Your failure to maintain accurate, complete and up-to-date Account information, including including invalid or expired payment methods on file, may result in your inability to access and use the Service or terminate this Agreement between you and CreditBird. You are responsible for all activities that occur under your Account, and you agree to maintain the security and confidentiality of your Account username and password at all times. Except as otherwise permitted in writing by CreditBird, you may own only one Account. User Requirements and Conduct. You may not authorize a third party to use your Account. You may not assign or otherwise transfer your Account to any other person or legal entity. You agree to comply with all applicable laws when using the Services, and that you may use the Services only for lawful purposes. By using the Services, you may not cause nuisance, inconvenience, inconvenience, or property damage, to the Third Party Providers or any other party. In certain circumstances you may be required to provide documentation of your right to access or use the Service, and you agree that you may be denied access to or use of the Service if you refuse to provide proof documents. CreditBird may, in its sole discretion, permit you to submit, upload, publish or otherwise make available to CreditBird, through the text, audio and/or visual features of the Service, content and information, including comments and feedback regarding the Services, support requests, and submissions for contests and promotions (“User Content”) from time to time. Any User Content provided by you remains your property. However, by providing User Content to CreditBird, you grant CreditBird a copyright-free, irrevocable, transferrable, perpetual, worldwide, license with the right to sublicense, to use, copy, modify, create derivative works of, distribute, make publicly available, publicly perform, and exploit in any way the User Content in all formats and distribution channels. current or hereinafter provided (including in connection with CreditBird's Services and business and on third-party websites and services), without further notice to or your consent, and without asking you or any other person or entity for payment. You are responsible for obtaining and updating compatible hardware or devices necessary to access and use these Services and Applications and any updates. CreditBird does not warrant that the Services, or any part thereof, will work on any particular hardware or devices. In addition, the Services may experience problems and delays that are common in the use of the Internet and electronic communications. 4. Payment You understand that use of the Services may incur costs for services or goods you receive from a Third Party Provider (“Fees”). Once you have received a service or goods through your use of the Service, CreditBird will facilitate the payment of the applicable Fees on behalf of the Third Party Provider as the Supplier's payment collection agent. Third-party. Payment of the Fees in this manner shall be deemed to have been made by you directly to the Third Party Providers. Fees will include applicable taxes if required by law. Fees paid by you are final and non-refundable, unless otherwise determined by CreditBird. You still have the right to claim a lower Fee from a Third Party Provider for services or goods received from a Third Party Provider at the time of receipt of the goods or services. CreditBird will respond to any request from a Third Party Provider to change Fees for a particular service or good. All Fees are payable immediately and payment will be facilitated by CreditBird using the preferred payment method specified in your Account, after which CreditBird will send you a receipt by email. If your Primary Account's payment method is determined to be expired, invalid or unchargeable, you agree that CreditBird may, in its role as Party Provider's payment collection agent, Third, use the second payment method in your Account, if available. You understand and agree that, where you are at your sole discretion to provide additional payment as a bonus to any Third Party Provider that provides you with services or goods received through this Service, You are under no obligation to do so. Bonuses are voluntary. Once you have received services or goods through this Service, you will have the opportunity to rate your experience and leave further feedback on the Third Party Provider. 5. Disclaimer; Limitation of Liability; Indemnify. DISCLAIMER. SERVICES IS PROVIDED “AS IS” AND “AS AVAILABLE”. CreditBird DISCLAIMER OF ANY STANDARDS AND WARRANTIES, EXPRESS, EXPRESSED, IMPLIED OR POLICY, NOT EXPECTED IN THESE TERMS, INCLUDING WARRANTIES OF TYPES OF TYPE OF COMPANY, AND NO VIOLATION OF LAW. YOU AGREE TO BE RESPONSIBLE FOR ALL RISKS OUT OF USE OF THESE SERVICES AND ANY REQUIRED SERVICES OR GOODS RELATED, TO THE LICENSE. LIMITATION OF LIABILITY. CreditBird WILL NOT BE RESPONSIBLE FOR INDIRECT, Random, SPECIAL, WARNING, PENALTY OR CONSULTANT DAMAGES, INCLUDING LOSS OF PROFITS, PERSONAL CHARGES, LOY DAMAGE TO PROPERTY, RELATIONSHIP, OR ARRIVING FROM THE USE OF THE SERVICES, EVEN IF CreditBird HAS BEEN WARNED OF THE RISK OF SUCH DAMAGES. CreditBird WILL NOT BE RESPONSIBLE FOR ANY DAMAGE, RESPONSIBILITY OR LOSS AGAINST BY: (i) YOUR USE OF OR BASED ON THE SERVICES OR YOU HAVE NO RIGHT TO USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND THE THIRD PARTY SUPPLIER, EVEN IF CreditBird HAS BEEN WARNED OF THE RISK OF SUCH DAMAGES. CreditBird WILL NOT BE RESPONSIBLE FOR DELAYS OR NO ACTIVITIES BECAUSE OF CAUSES OUT OF CreditBird's CONTROL. YOU ACCEPT THAT THIRD PARTY SHIPPING SUPPLIER PROVIDES REQUESTED SHIPPING SERVICES THROUGH SOME REQUIRED BRANDS CAN PROVIDE GENERAL TRANSPORTATION AND COMPLETE TRANSPORTATION SERVICES LICENSE OR LICENSED PROFESSIONAL. IN ANY CASE CreditBird IS NOT LEGAL TO YOU RELATED TO THE SERVICES FOR ANY DAMAGE, LOSS AND CAUSES OF PROCESS. THE LIMITATIONS AND DISCLAIMER IN THIS SECTION 5 DO NOT EXPRESS LIMITATION OF LIABILITY OR REPLACE USER RIGHTS THAT CANNOT BE EXCLUDED BY LAW. Indemnify. You agree to indemnify and hold CreditBird and its officers, directors, employees and agents harmless from any and all claims, claims, liabilities, and expenses (including including attorneys' fees) arising from or in connection with: (i) your use of these Services, services or products obtained through the use of these Services; (ii) you break or violate these Terms; (iii) CreditBird's use of User Content; or (iv) you violate the rights of any third party, including a Third Party Provider. 6. CreditBird may give notice by means of general notice of the Services, by electronic mailing to the email address in your Account, or by written communication mailed to the address listed in your Account. You consent to CreditBird's right to assign or transfer these Terms, in whole or in part, to: (i) a subsidiary or affiliate; (ii) the bank that settles CreditBird's equity, business or assets; or (iii) the successor due to the merger. No joint venture, partnership, employment or agency relationship exists between you, CreditBird or any Third Party Provider as a result of the contract between you and CreditBird or your use of the Services. . If any provision of these Terms is held to be unlawful, void or unenforceable, in whole or in part, then that provision or part, under any provision of law, to that extent shall not be deemed a part of these Terms but the legality, validity and enforceability of the remaining provisions of these Terms shall not be affected.
